This document governs the purchase, download, use, construction, and implementation of the DIY

Storm-Resistant Flagpole system offered by Fun With Flagpoles LLC (“Company”). By purchasing,

downloading, accessing, or using the plans, diagrams, instructions, or related materials (“Plans”), you

agree to the following Terms of Service, Disclaimer, and Legal Notice.

1. Acceptance of Terms

By accessing or purchasing the Plans provided by Fun With Flagpoles LLC, you acknowledge that you

have read, understood, and agreed to these Terms. If you do not agree, you must not download, access, or use the Plans.

2. Nature of the Product

The Plans provided are informational and educational in nature and describe a do-it-yourself

construction project. The Company does not sell a finished flagpole product. The Company provides

digital instructions only. All construction, installation, and use are performed entirely at the user's own

discretion and risk.

3. DIY Construction Responsibility

The Plans describe a project intended to be constructed by individuals using commonly available

materials. Users assume full responsibility for:

     • Selection of materials 

     • Structural integrity of materials 

     • Proper construction techniques 

     • Installation method 

     • Compliance with local building codes 

     • Compliance with local zoning laws 

     • Safe operation and maintenance.

Fun With Flagpoles LLC cannot and does not supervise or control the quality of materials, tools, or

workmanship used by users.

4. Assumption of Risk

Construction projects involve inherent risks including but not limited to personal injury, property

damage, tool misuse, structural failure, and environmental hazards.

By using the Plans, the user expressly assumes all risks associated with:

• Construction of the flagpole 

• Installation of the flagpole 

• Operation of the flagpole 

• Environmental exposure including:

• wind
• storms
• lightning
• freezing temperatures
• soil conditions

5. No Structural Guarantee

The design described in the Plans is intended as a storm-resistant design concept. However, the

Company makes NO guarantee or warranty that the constructed flagpole will withstand any specific

wind speed, weather condition, soil condition, or structural load.

Actual performance depends on materials used, construction quality, installation conditions,

maintenance practices, and environmental factors beyond the Company’s control.

6. Cold Weather Warning

PVC materials may become brittle at lower temperatures. Users are advised that flagpoles constructed

using PVC components should generally be lowered or removed when temperatures are expected to

remain below 40°F (4°C) for extended periods of time.

Failure to do so may increase risk of material cracking or structural failure.

7. Limitation of Liability

To the maximum extent permitted by law, Fun With Flagpoles LLC shall not be liable for:

     • Personal injury 

     • Property damage 

     • Loss of property 

     • Structural failure 

     • Installation errors 

     • Improper materials used 

     • Misinterpretation of instructions 

     • Environmental damage or weather events

This limitation applies whether the claim is based in contract, negligence, strict liability, or any other

legal theory.

8. Indemnification

By using the Plans, the user agrees to indemnify, defend, and hold harmless Fun With Flagpoles LLC

and its members, owners, partners, contractors, and affiliates from any claims, damages, liabilities,

legal fees, or expenses arising from the construction, installation, or use of the flagpole system.

9. No Professional Advice

The Plans do not constitute engineering advice, structural certification, or professional construction

guidance. Users should consult licensed professionals where appropriate, particularly for installations

subject to local codes or significant structural loads.

10. Intellectual Property

All plans, diagrams, drawings, photos, text, and design concepts remain the intellectual property of Fun

With Flagpoles LLC.  Purchasing the Plans grants the buyer a personal, non-transferable license to construct the system for personal use. Resale, redistribution, reproduction, or commercial reproduction of the Plans is prohibited without written permission.

11. Digital Product Policy

Because the Plans are delivered digitally and become immediately accessible after purchase, all sales are considered final and non-refundable except where required by law.

12. Modifications

Users may modify the design for personal use. However, any modification is undertaken entirely at the

user's own risk. Fun With Flagpoles LLC assumes no responsibility for modified designs.

13. Weather and Environmental Disclaimer

Wind, storms, lightning, freezing temperatures, soil conditions, and installation location all affect the

performance of outdoor structures. The Company cannot predict or guarantee performance in any

specific environmental condition.

14. Governing Law

These Terms shall be governed by the laws of the State of Ohio, United States, without regard to

conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in

full force and effect.

16. Updates to Terms

Fun With Flagpoles LLC reserves the right to update or modify these Terms at any time. Continued use

of the Plans constitutes acceptance of the current version.
